Information, not legal advice

The content on this site is general information about Washington’s Clean Buildings Performance Standard and the Tier 2 Early Adopter Incentive. It is not legal, tax, or engineering advice, and it is no substitute for reading the requirements yourself or consulting a qualified professional.

We work to keep the content accurate and point each figure to the Washington State Department of Commerce. Commerce sets the requirements, deadlines, and incentive amounts, and they can change. Where this site and Commerce differ, Commerce is the authority.

Independent service

Easy BPS is an independent service. We are not part of, or endorsed by, the Washington State Department of Commerce, the U.S. Environmental Protection Agency, or any utility.

The building checker

The checker gives an estimate based only on the floor area and primary use you enter. It does not decide whether your building is covered, and it does not guarantee an incentive. Commerce decides coverage. Incentives depend on Commerce certifying your filing, on your utility, and on money remaining in a program that pays first come, first served.

Our services and pricing

Prices shown on this site, currently $5,500 for a standard filing on a single building, describe our standard pricing and may change. Standard pricing assumes required building and utility records are readily available; additional fees may apply for missing records, extensive research, or unusually complex filings, and we will tell you about any additional cost before work proceeds. Compliance work is provided under a separate written agreement, and that agreement controls the scope, price, payment, and each party’s responsibilities. Half of the price is due at contract signing and half when we submit your filing to Commerce, and it does not depend on the incentive being approved or paid. Nothing on this site is a binding offer on its own.

Building owners remain responsible for their own compliance with the standard, including giving us accurate information and putting their Energy Management Plan and Operations and Maintenance Program into practice.

Using the site

You may use this site for lawful purposes only. Do not try to disrupt it, gain unauthorized access to it, or copy it in bulk for commercial use. Search engines and AI assistants are welcome to read, index, and quote the site, as described in its llms.txt file and agent guide.

Intellectual property

The site’s text, design, logo, and code belong to Easy BPS or its licensors. You may quote short passages with a link back to the site. Figures and documents from Commerce and other public sources remain theirs.

Links to other sites

We link to Commerce, ENERGY STAR, Calendly, and other sites for your convenience. We do not control them and are not responsible for their content or practices.

Disclaimer

To the fullest extent the law allows, the site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, Easy BPS is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost incentives, penalties, or profits, arising from your use of this site or your reliance on its content. This does not limit any obligation we take on in a signed services agreement.

Indemnity

If you misuse the site or break these terms and that leads to a claim against us, you agree to cover the reasonable costs of that claim, including legal fees.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict of law rules.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and using the site after an update means you accept the new terms.
